ACCESS AND USE OF CANADIAN OLYMPIC COMMITTEE IMAGES (COC IMAGES) AVAILABLE THROUGH THIS WEBSITE IS SUBJECT TO THESE TERMS OF USE. THE COC IMAGES ARE OWNED BY THE CANADIAN OLYMPIC COMMITTEE (COC) AND ARE PROTECTED BY COPYRIGHT AND/OR OTHER RIGHTS AS WELL AS APPLICABLE LAW. ANY USE OF THE COC IMAGE(S) OTHER THAN AS AUTHORIZED UNDER THESE TERMS OF USE IS PROHIBITED. BY ACCESSING AND USING ANY COC IMAGES THROUGH THIS WEBSITE, YOU ACCEPT AND AGREE TO BE BOUND BY THESE TERMS OF USE.

1. Limited License: This is a, royalty-free, non-exclusive, non-sublicensable, non-transferrable, limited, revokable and restricted license for YOU to download and use the COC Image for internal, personal, educational, editorial or other non-commercial purposes. YOU may not use or authorize any other person to use the COC Image in any other manner or for any other purpose whatsoever.

2. No Alteration: YOU may only use the COC Image in its entirety, respecting its original format and editorial context. YOU may not make any modification or alteration of any kind (including by applying text or design features)  to the COC Image without COC prior written approval. YOU may not delete, blur out, cover up or change any copyright, trademark, or other proprietary notices of the COC Image.

3. Good Faith Use: YOU may only use the images in a manner consistent with the good name, goodwill, reputation and image, as applicable, of each of the athletes depicted, the IOC, COC, and the Olympic Movement and Applicable Laws. YOU may not transfer the COC Images to, or make the COC Images available for use by another individual.  

4. No Commercial Use: YOU may not exercise any of the rights granted to YOU in these Terms of Use in any manner that is primarily intended for or directed toward commercial advantage or private monetary compensation or for any commercial, promotional, advertorial or endorsement purposes. None of the COC Images may be used in any way that creates or implies any association between on the one hand the COC Image (or individuals depicted therein), the Canadian Olympic Committee/Canadian Olympic Foundation/Canadian Olympic/Pan American Games Team, Olympic brand and/or Olympic Movement, and on the other hand, any third party, brand, product, service and/or event.

5. Clearances: This license does not include the right to any trademarks, logos, or brands, artworks or other copyrighted works, or identifiable individuals images that appear in the COC Images.  YOU agree YOUR use will not infringe or misappropriate any third party right, including copyright and other intellectual property rights, privacy rights, rights of publicity, or moral rights, or slander, defame, or libel anyone.  YOU are solely responsible for abiding by all laws relating to your use and exploitation of COC images, and for obtaining any rights clearances related to, and securing any other permissions, consents or releases and making any payments or fees required in connection with, YOUR use of the COC Image, including image rights for persons featured therein, and the COC shall have no liability in this respect.  

6. Copyright: The COC owns the rights with respect to all COC Images. No right, title, or interest in any COC Image is transferred to you as a result of the present Terms of Use. Please be advised that the COC enforces its intellectual property rights to the fullest extent of the law. We reserve all rights that are not specifically granted under these Terms of Use. You must include the following credit format near the photo or in production credits: “[Photographer Name]/Canadian Olympic Committee”.

7. No Warranty. Unless otherwise mutually agreed to by the parties in writing, COC offers the images as-is only to the extent of any rights held in the licensed COC image by the COC. The COC makes no representations or warranties of any kind concerning the COC images, express, implied, statutory or otherwise, including, without limitation, warranties of title, marketability, merchantability, fitness for a particular purpose, noninfringement, or the absence of latent or other defects, accuracy, or the presence of absence of errors, whether or not discoverable, some jurisdictions do not allow the exclusion of implied warranties, so such exclusion may not apply to you.

8. Release and Indemnity: You hereby expressly and knowingly waive and release COC and its directors, officers, licensees, representatives, employees, agents, from any and all claims, fines, damages or other liabilities whatsoever in connection with the COC Images or the exploitation of COC Images, and agree to indemnify, defend and hold harmless COC from any liabilities, damages, costs and expenses resulting directly or indirectly from the COC Images.   

9. Limitation on Liability. In no event will COC be liable to you on any legal theory for any damages, including any special, incidental, consequential, punitive or exemplary damages arising out of this license or the use of the COC images, even if COC has been advised of the possibility of such damages.
   
10. Termination. This license and the rights granted hereunder will terminate automatically upon any breach by YOU of these Terms of Use. COC may update, modify, or even discontinue access to the COC Images at any time without notice to you.
